Below is a general example of our agreement to publish.  It outlines the terms and conditions that are agreed to by The Bookcliff-group and by those submitting work for publication to us.  It is considered that this agreement exists between us and anyone who submits work for publication.

If you do not agree to these terms and conditions please do not submit your work to us even if you are requesting it to be published and made available to the public free of charge.

Although this example uses the term author it is understood that the terms Author, Artist, Poet, Photographer are applied as appropriate to each submission.

The Bookcliff-Group Electronic Publisher's Agreement for Publication of Submissions effective November 19, 1999.  Agreements  prior to this date remain unaffected by any changes herein.

This agreement states terms and conditions between The Bookcliff-Group Electronic Publishers herein called the publisher, and _ _Your Full Name__ herein called the author. This agreement pertains to electronic publication of the author's work.

The following terms shall have, for the purposes of this agreement, the meaning stated below.

Publication as referred to in this document shall mean making available through electronic media any work of the author to any person or persons other than the author or the publisher, or the employees of the publisher in their work.

Electronic media shall mean any reproduction, or transmission involving the use of computers, the internet, or any device using magnetic or digital technology, or facsimile thereof.

The terms author, artist, photographer, poet, or  writer shall mean an original creator, and shall mean for the purpose of  this agreement the individual or individuals whose name or names are attached to or associated with, as the originator of,  any work submitted in part or in total for publication.

Authors rights shall for the purpose of this document mean the right of the author to sell assign or give to anyone, permission to reproduce in any manner or media, his or her work for any purpose.

Submission shall mean, for the purpose of this document, transmitting by printed or electronic media, part of, or all of, any work claimed by the individual submitting such work as her or his creation for consideration for publication.

Such a submission shall be deemed by publisher to be a guarantee by the person or persons making the submission that they
are the author or authors as indicated above, and or that they legally own the rights to such work being submitted,  and are giving full and complete credit to the originator of the work.

By submitting work to The Booklciff-Group you assume all risks associated with public display of the work.  You  also attest as fact that you own the legal rights to such work.  You further  agree to indemnify The Bookcliff-Group from any  legal liability for any and all copyright infringements, or allegations of infringements that may arise as a result of the submission or display of your work or works.

You retain all rights to your work, but grant The Bookcliff-Group permission to display and or sell electronic reproductions of the work you submit.  You also grant The Bookcliff-Group the right to display on its web site any and all work you submit.

You further agree that The Bookcliff-Group shall retain these rights until such time that you indicate by registered letter or  acknowledged e-mail that you desire removal of the work you submitted from the site.

If you are making a  submission, you are hereby cautioned that misrepresentation of authorship or ownership of  a copyrighted work  is strictly illegal.  Any misrepresentation of authorship or ownership of a  submission may subject the individual making such a misrepresentation to criminal prosecution and/or personal liability in a civil action.

The contract terms between the publisher and author are as follows.

The author agrees to and encourages publication and or marketing of submitted work by the publisher.

(The below agreement of commission applies only in the event that a signed contract exists between the submittor and The Bookcliff-Group for the purpose of commercial sale of submitted material.  It shall not apply to work published and provided to the public free of charge.)

The author agrees to a fee of twenty percent (25%) of the sale price (if  any) to be retained by the publisher.

The person submitting work for consideration agrees that she or he is the original creator of the work submitted, and agrees to indemnify the publisher in the event of actions arising as a result of false or misleading claims of ownership or authorship of the submitted material.

The author retains all rights to the material submitted and to the  profit there from except as stated in this contract.

The author and publisher both certify that any and all published material remains available through the Bookcliff-Group only as long as both parties agree; and that such availability is subject to cancellation at any time by either party.

The  author  agrees that he shall receive a check from the publisher for the amount of the purchase price, not including charges for shipping and handling, and minus a twenty-five percent publishers fee for all sales. Any sale or combination of sales from which the author is entitled to an amount that is in excess of fifty dollars ($50.00) shall be paid within a thirty day time period from date of the sale that brings the total due the to the author to more than fifty dollars ($50.00).

The publisher further agrees not to change or modify the work of the author except for correction of grammar, spelling, and/or punctuation, without permission of the author.  Such permission to be given by e-mail. The publisher reserves the right to alter format and or media without altering content.

The publisher retains no rights to the authors work or to profit there from except as outlined in this contract.

The publisher agrees to provide once to the author a copy of the disk or other media used to present the authors work for
publication. The foregoing shall not include web pages. This shall be done if requested by the author.

This agreement shall be for the publication of any and all material submitted by the author to The Bookcliff-Group or its representatives.  The signatures below are in witness of the fact that both parties have read and agree to the above stated terms and conditions.
